Brazil’s INSS

The Instituto Nacional do Seguro Social (INSS) is the Brazilian institution that awards and pays benefits under the Regime Geral de Previdência Social. Its role in occupational accidents and diseases belongs to public social security and includes incapacity benefits and compensation for certain lasting impairments, depending on the insured person’s category and the applicable legal requirements.

At a glance

The INSS provides income protection in connection with occupational harm. Temporary incapacity, permanent incapacity, compensation for residual impairment and accident notification are separate concepts, each with its own purpose and eligibility conditions.

Its place in Brazil’s system

The INSS administers benefits within a general scheme that also covers events unrelated to work. It is therefore not a specialist commercial occupational insurer selected by an employer. Awarding a cash benefit must also be distinguished from providing routine healthcare. Membership of the scheme and the person’s insured status establish the relevant framework for protection.

Temporary incapacity and occupational origin

Official guidance distinguishes ordinary temporary incapacity from incapacity arising from an occupational accident. Both concern a temporary inability to work, but recognising an occupational origin can change requirements and consequences. A medical diagnosis does not, by itself, replace the assessment of incapacity or establish that a condition is attributable to employment.

Residual impairment and permanent benefits

Auxílio-acidente is a compensation benefit for a lasting reduction in capacity for the person’s usual activity after injuries have stabilised. It is different from a permanent incapacity pension. INSS guidance identifies eligible categories and exclusions: not every contributor qualifies for this benefit, and an injury does not automatically give rise to payment.

What the CAT records

Comunicação de Acidente de Trabalho (CAT) is the notification used for occupational accidents or work-related disease. Reporting an event and claiming a benefit are different steps. Records of the incident, exposure history and medical reports serve distinct purposes in the assessment. Notification documents the event; it is not itself a decision granting the requested benefit.

Prevention and returning to work

The system includes vocational rehabilitation where appropriate, considering the person’s capabilities and the institutional process. This does not transfer employers’ duties to prevent harmful exposures and correct unsafe conditions. International comparisons should distinguish RGPS benefits, healthcare provision and the employer’s occupational safety and health responsibilities.

Frequently asked questions

Is auxílio-acidente temporary sick pay?

No. It compensates certain lasting impairments that reduce capacity for usual work. Temporary incapacity has a separate benefit and assessment process.

Does INSS protection apply identically to everyone who works?

No. Scheme membership, insured category and the benefit requested affect eligibility. A rule applicable to one category should not be assumed to cover all other categories.
